On May 11 1973 charges against my father, Daniel Ellsberg, and co-defendant Tony Russo were dismissed for their copying of the Pentagon Papers, a Top Secret history of the Vietnam War. The judge cited massive government misconduct. My father had faced 115 years in prison.

Judge Byrne did not earn full marks. He only acted after it was revealed he had met 2x with the President and his men to discuss an appointment as head of the FBI following the conclusion of the trial. As it turned out, history did not smile on Judge Byrne.
