Whenever the Senate rejects a voting-rights bill, I think of this infamous comment by Scalia in the Shelby County v. Holder arguments where he called the VRA a "racial entitlement."

Congress was never going to scrap the VRA because it was pretty popular and pretty effective. So the court gutted it and said, "Well, Congress can fix this," knowing full well that the GOP wouldn't allow it.

Don't be fooled by the "equal sovereignty of the states" thing he mentions, either. SCOTUS isn't forcing Congress to send ethanol subsidies to Alaska or build Navy bases in Kansas.

"Racial questions" should be left to Congress, unless they come up with an answer I don't like.
